In late 2018, the Western Australian Government introduced amendments to the Occupational Safety and Health 1984 (WA) and Mines Safety and Inspection Act 1994 (WA) to align penalties with the Model Work Health and Safety Act’s (“Model WHS Act”) penalties (plus inflation). With the increased penalties, including inflation, Western Australia now has the highest maximum penalties for WHS offences in Australia.
